Site Terms of Use
These Terms of Use establish the rules governing access to and use of the 55+ website (“Site”).
The Site is owned and operated by Movimento 55+ Associação, with registered office at Rua Almeida e Sousa, no. 48, 3rd floor left, Lisbon, Portuguese corporate tax number (NIPC) 514859172 (hereinafter “55+”), and its use is governed by these Terms of Use.
These Terms of Use are supplemented by the Privacy and Cookies Policy and the Terms and Conditions for the Provision of Services, which should be read together.
1. ACCEPTANCE OF THE TERMS OF USE
The user of the Site (“User”) acknowledges that, by accessing, browsing and using the Site, they accept these Terms of Use.
If the User does not agree with any of the rules set out herein, they should refrain from using the Site.
2. DESCRIPTION OF THE SITE
The Site is an intermediation platform connecting people aged 55 or over who wish to provide services (“Talents”) with individuals or legal entities wishing to purchase those services (“Clients”).
55+ acts as an intermediary, facilitating the connection between Talents and Clients.
3. ACCESS TO THE SITE
Anyone may access and browse the Site.
Anyone wishing to become a Talent must complete the registration form available on the Site.
Anyone wishing to purchase a service as a Client must submit the corresponding request using the form available on the Site.
Registration as a Talent or submission of a service request as a Client is subject to the following requirements:
- Only individuals aged 55 or over with full legal capacity may become Talents;
- Only individuals aged 18 or over with full legal capacity, or legal entities, may become Clients;
- All information requested by 55+ must be provided;
- All information provided must be true, accurate and up to date;
- Forms and requests must not be completed under false or fraudulent pretences or by automated means.
General access to the Site does not require registration. However, access to certain features, particularly becoming a Talent, may require the creation of an account. Clients may also create an account if they wish.
Account access credentials must be kept confidential and must not be disclosed to third parties.
The User is responsible for the use of their account and must keep their information accurate and up to date.
In the event of loss, theft, misuse or compromise of access credentials, the User must contact 55+ as soon as possible.
4. PROVISION OF SERVICES BY TALENTS
Each Talent may offer the services indicated in their registration form, provided that they comply with the applicable requirements set out on the Site and in these Terms of Use.
The services offered must fall within the service categories accepted by 55+.
When contacted by 55+ regarding a request, the Talent must confirm their availability to provide the service. Once the service has been accepted, the Talent undertakes to perform it in accordance with the agreed terms.
The provision of services is also subject to the Terms and Conditions for the Provision of Services.
Talents undertake not to provide directly, outside 55+'s intermediation, services requested by Clients who have been introduced to them through 55+. If contacted directly by such a Client to perform a service, the Talent must inform 55+ so that the request can be duly regularised.
The Talent is responsible for:
- Holding any authorisations legally required to provide the services;
- Ensuring the quality of the services provided and, where applicable, of any materials or products used;
- Setting the hourly price for the services they wish to provide. 55+ may indicate a recommended rate in the registration form based on market rates in the relevant territory;
- Complying with all applicable tax obligations, including the payment of any taxes due in connection with the provision of the services;
- Ensuring that all information, data, photographs and other content provided are true, accurate and lawful and that they hold the rights necessary to use them;
- Ensuring that the services and content provided comply with applicable law.
The Talent is also responsible for the performance of the services they agree to provide and acknowledges that registration on the platform does not guarantee that their services will be contracted.
55+ reserves the right to accept or reject a Talent's registration or the availability of certain services and, for each Client request, to select the Talent it considers most suitable.
55+ is also responsible for determining the conditions governing the presentation, visibility, communication and promotion of Talents and services through the Site and other communication channels.
By providing photographs, texts or other content to 55+, the Talent authorises 55+ to use, reproduce and disseminate such content for purposes related to the communication, promotion and dissemination of 55+'s activities, Talents and services, in accordance with applicable law.
5. PURCHASE OF SERVICES
Any Client may request a service offered through 55+, and the Terms and Conditions for the Provision of Services will also apply.
Before contracting, the Client will receive information about the main characteristics of the service, the applicable price and relevant information regarding the Talent selected to provide the service.
Payment may be made using the payment methods made available by 55+ from time to time.
Certain payment systems are provided by third parties and may be subject to their respective terms and conditions.
As an intermediary between the Talent and the Client, 55+ will manage the administrative and financial aspects of the service in accordance with the Terms and Conditions for the Provision of Services.
6. RELATIONSHIP BETWEEN TALENT AND CLIENT
The Talent and the Client establish a relationship with each other concerning the provision of the contracted service.
The Talent is responsible for the proper performance of the service they have agreed to provide.
55+ acts as an intermediary, facilitating the connection, communication and management of the service between the Talent and the Client.
Whenever a problem, complaint or disagreement arises in connection with a service, the Talent and Client must report it to 55+ at info@55mais.pt so that 55+ may follow up on the situation and seek to facilitate its resolution.
7. 55+ REMUNERATION
For use of the platform and the intermediation, management and support services provided by 55+, a margin will apply which may vary depending on the service and averages approximately 30%.
Amounts, invoicing conditions and payments to Talents will be processed in accordance with the Terms and Conditions for the Provision of Services and applicable law.
8. REMOVAL OR SUSPENSION OF SERVICES AND CONTENT
55+ may review content provided by Talents to the extent necessary to adapt it to the platform's presentation and communication requirements.
55+ may reject, remove or suspend services or content that:
- breach applicable law;
- breach these Terms of Use;
- infringe third-party rights; or
- must be removed pursuant to a decision of a competent authority.
9. GENERAL RULES FOR USE OF THE SITE
Users must use the Site responsibly, prudently and lawfully.
In particular, Users may not:
- Use the Site for illegal, fraudulent or offensive purposes;
- Provide false, misleading, threatening, abusive, defamatory, discriminatory, obscene or unlawful content;
- Provide third-party content without authorisation;
- Infringe intellectual property, privacy or other third-party rights;
- Introduce or transmit viruses, malware or other elements capable of damaging computer systems;
- Attempt to gain unauthorised access to accounts, systems, servers, networks or data;
- Carry out phishing, denial-of-service attacks or other actions intended to compromise the operation or security of the Site;
- Collect or use other Users' data for unauthorised purposes;
- Reproduce, modify, decompile or exploit the Site without 55+'s authorisation;
- Use the Site to transmit unsolicited commercial communications or SPAM.
If the User identifies any defect, vulnerability or anomaly on the Site, they must notify 55+ and must not exploit the situation to gain unauthorised access to data or functionality.
10. INTELLECTUAL PROPERTY RIGHTS
The Site, its structure, design, content, functionality, software, trademarks, logos and other elements are owned by 55+ or are duly licensed for use by 55+.
Texts, images, graphics, photographs, videos, sounds and other content made available on the Site are protected by applicable intellectual property rights.
Unless previously authorised in writing by 55+, the User may not copy, reproduce, modify, publish, distribute, commercialise or use such content for purposes other than those for which it is made available on the Site.
11. PERSONAL DATA
Simply browsing the Site does not necessarily involve providing personal data.
However, certain features — including registration as a Talent, submission of service requests, contact requests, complaints or other communications — involve the processing of personal data.
Personal data will be processed in accordance with 55+'s Privacy and Cookies Policy.
12. LIABILITY
55+ acts as an intermediary between Talents and Clients and is not a party to the contractual relationship established between them concerning the provision of the service.
55+ is not liable for the quality, safety, legality or proper performance of services provided by Talents, or for acts or omissions attributable to Talents or Clients.
Without prejudice to liabilities that cannot be excluded or limited by law, 55+ will not be liable for damage arising from, among other things:
- temporary unavailability or malfunction of the Site;
- Internet or telecommunications system failures;
- problems with or unavailability of third-party payment systems;
- misuse of access credentials by the User or third parties;
- unlawful acts of third parties;
- unforeseen events or force majeure.
13. WARRANTIES
55+ seeks to ensure the proper functioning and updating of the Site but does not warrant that it will operate continuously without interruptions, errors or failures.
Information made available on the Site should not be interpreted as a guarantee that a particular service or Talent will necessarily meet the specific expectations of each User.
14. LINKS TO THIRD-PARTY WEBSITES
The Site may contain links to third-party websites or platforms.
55+ does not control such websites and is not responsible for their content, policies, security or operation.
Use of third-party websites is the User's responsibility.
15. SECURITY
55+ adopts measures intended to protect the security and integrity of the Site.
However, it is not possible to guarantee absolutely that the Site will remain permanently free of viruses, failures or other harmful elements.
Each User must also take appropriate measures to protect their equipment, accounts and access credentials.
16. SUSPENSION OR TERMINATION OF THE ACCOUNT AND SITE
55+ may suspend or terminate an account or access to certain features where there is a breach of applicable law, these Terms of Use or the Terms and Conditions for the Provision of Services, or where required by a competent authority.
Where applicable, 55+ will inform the User using the contact details provided.
55+ may also temporarily suspend access to all or part of the Site for maintenance, updating, security or platform improvement purposes.
A Talent may request the closure of their account or removal of their services using the features made available for this purpose or by contacting 55+ at info@55mais.pt.
17. AMENDMENTS TO THE TERMS OF USE
55+ reserves the right to amend or update these Terms of Use.
The updated version will be available on the Site, together with the relevant update date.
Users should review these Terms of Use periodically.
18. VALIDITY
If any provision of these Terms of Use is held to be invalid, unlawful or unenforceable, this will not affect the validity of the remaining provisions.

20. GOVERNING LAW AND JURISDICTION
These Terms of Use are governed by Portuguese law.
The Judicial Court of the District of Lisbon (Tribunal Judicial da Comarca de Lisboa) shall have exclusive jurisdiction over any dispute relating to these Terms of Use, with express waiver of any other jurisdiction.
